Question by yo m: Am i responsible for the debt of my spouse? He took out a personal loan and put our address on there. from CA?
He did it without my knowledge and now the collectors are coming after me instead of him. I feel like I should have no responsibility for it since i did not have knowledge of the loan.

In theory, is there some way that a law could be made in the USA where all debt is declared void?

January 8th, 2012

Question by THE GUARDIAN OF FOREVER: In theory, is there some way that a law could be made in the USA where all debt is declared void?
Could the Constitution be ammended to declare all debt, personal, corporate, etc – totally VOID?

Could this be done?

Answer by MavistheMaven
Sure, technically any amendment could be added to the Constitution, as long as it doesn’t contradict an existing part of the Constitution.

Even if they wanted to declare all debts void, they probably wouldn’t do it as a Constitutional amendment, because that’s more for ongoing things, and voiding existing debts would be a one-time thing.

They do have things like tax amnesties or debt forgiveness now and then. I doubt they would ever enact a law voiding all debts, because that would mean that every business owed any money at all by anyone would lose it. Also, individuals would lose what they were owed. And some debts cross national lines, and the US Government doesn’t have control or say-so over those.

Well, I suspect any attempt to do that would be declared unconstitutional, so you’re right, they’d have to do it as an amendment. It would be considered a rescinding of the right to “life, liberty and the pursuit of happiness” – because most debts are someone’s way of eaning a living, so they be taking away the right to life in that sense. I can’t imagine that ever going over.

Do you think there would be markedly less personal debt in the US if television advertisements did not exist?

January 1st, 2012

Question by Method To The Madness: Do you think there would be markedly less personal debt in the US if television advertisements did not exist?
In your opinion, do you believe that the number of American consumers that are in debt today, would be a dramatically lesser figure if commercials were never created (whether it be from TV, radio, internet, billboards etc)? Do you think it would even make a difference? Lastly, would you enjoy TV, radio, the internet, and your drive home from work– waaayy more if advertisements were non-existent? Personally, I can not stand someone trying to sell me “the new something” everyday of my life!

[A side note: A recent study revealed that the average American is able to identify over 1,000 + company's (fast food, clothing brands, car makes/models etc) just from a glimpse of their logos, but could identify less than 10 plants and animals native to their own region]

If anyone even answers…I thank you for your thoughts lol : )

Are most Americans living beyond their means? Is there, too much personal debt?

December 13th, 2011

Question by sanrun: Are most Americans living beyond their means? Is there, too much personal debt?
In the past 20 years, I have seen a dramatic increase in the amount of credit that is offered. I get at least 2 or 3 credit card applicantions in the mail a week and receive regular phone calls about home equitiy loans and debt consolidation. Back in 1983, I had to establish credit by getting a department store card, before Visa or Mastercard would offer me one. I had a full time job at the time and wasn’t carrying any debt, either! Now, college kids, who work part time can get major credit cards!

I live within my means and do not carry more debit then I can handle if I lost my job tomorrow. We paid our home off in less than 15 years, we had a 20 year loan and made extra payments. I don’t have the numbers in front of me, but we saved a lot of money by doing that! Anyway, my advice to all Americans is to limit your debit and live within your means.

I’m stuck in a rut. Disabled & unemployed. No one wants to hire me because they see my Tourette’s tics & get freaked out. I alreadyhave my college degree, & employers overlook that & think I’m just a wacko thinking out of my head. What do I do?

I have credit card debt & personal loan debt from trying to replace my losses from Hurricane Katrina. I’ve been financially struggling ever since.

The only way you’ll know is to ask. Some companies will work with you, some won’t. It never hurts to ask. But cut up the cards. It’s better to do without than to go into debt any further.

do business partners share their debt even though it’s there own personal, education debt?

November 14th, 2011

Question by Sandra: do business partners share their debt even though it’s there own personal, education debt?
If business partners each have their own education debt and they start a business together does the debt all get put together and so pay it off together as a whole or do you still see the two debts as separate and so pay two seperate yearly debt pay offs, so pay two $ 2,400 per year (total 4,800) instead of just one $ 2,400

Their education debt will be personal, and not linked through their partnership.

Just remember, one person’s debt must be another’s asset. So while there may be considerable private debt in the US, it is generally owed to American people and corporations.
