Question by Rubberband Man: can a debt collector seize $ / assests from my LLC for a personal credit card debt not connected to the LLC ?
i have some credit card debt probably 3-4 cards to the tune of about $ 5,000. that was prior to my forming my self employed service business into an LLC (ohio), and this debt has no connection to the LLC (single member) and if i am not able to settle or othewise make payments its likely they will go to court and get a judgement. SO…. what then? can they with such a judgement seize personal property? such as a motorcycle ( $ 4,000.) or attach a lein on my house? Can i open an LLC for just me as a person? to be alble to continue living ( paying bills) or will i have to use “undercover” services to pay my bills? My LLC will be paying me…. do i ihave to live and pay with cash forever? I want to pay or settle wilth them but if i can not i have decided to keep my house (by paying on IT) VS lose my credit / credit cards by NOT paying on them

This has happened on more than one occasion with the same collector.

No law requires the debt collector to keep your info private. Many will use the disclosure to try to enlist others into persuading you to pay your debts.

I owe them around $ 1300 which I am willing to pay, but I am not willing to give them my bank info as they are asking for. They wont take cashiers check or money order. The company is Monarch.. any advice on how to get this debt paid?

You are correct – do NOT give them your bank info. They only reason they are claiming that they “can’t” take it is to get your bank account info. Tell them it’s a money order or nothing.

called them to resolve it they are asking my S S number, my date of birth, and some more personal information. are they allowed to ask me these question and what are my rights…Please help.
Debt collector is a law firm and got a court order to put a hold on my account for twice the money that is in dispute.

Did you have a court judgment against you?

Banks, whether intentionally or not can betray you and cannot be trusted. They’re usually okay for small amounts, but you can’t depend on them beyond that. “Safety” deposit boxes are also not safe.

This woman has called my stepdad, my grandmother, my stepdad’s x wife telling them I am behind in my car payments that they are issuing a warrant for my arrest. Also said some pretty bad things to my stepdad’s x-wife about my character

Consult an attorney. This is highly illegal if it’s a debt collection business.

I was laid off from work and was unable to make payments on an account. Although I found a part time job, I was hired and expecting to start a full time job in two months. The debt collector (Lisa) called me on my part time job and I explained to her that I will make payments as soon as I start working full time; she became angry, cursed at me and hung up on me. Lisa then started calling my boss twice a day. My boss told her not to call there again because it was a personal matter. So Lisa, then started calling and harassing my co-workers. Everyone in my office is tired of this debt collector, Lisa, calling, using abusive language and harrassing our entire office. This debt collector, Lisa, seems to be turning this matter into a personal vendetta. Her name is Lisa Wenzel of Pioneer Credit Recovery 1-866-746-4853. How do you stop people like this and who do you report this type of behavior to? Has anyone ever had her call and behave in an unprofessional manner ?

turn her into the better business bureau and file a lawsuit for harrassment against her. you would win hands down with all the witnesses. and guess what……she would be fired from her job and hopefully she will get those same terrible phone calls about her bills. she is way out of line and what she is doing is illegal. check with an attorney. you will see.

I was recently behind on a couple of payments on my car note due to an illness and not being able to work. The account manager threatened to reposses my car if i did not make payment that day (which I did). She also asked me in exact words “What exactly is wrong with you” and then threatend to repossess my car because she claimed I was to sick to pay. Was the debt collector wrong for asking this type of question, are there any legal actions that I can take against this?

I know about The Fair Debt Collection Practices Act
15 U.S.C. ยง 1792; and that it is illegal for the agency to contact an employer, but I think they can get away with doing it once?

Well that kinda depends if the debt is a federal or state debt they can but just to any bill collector i think not!!!!!!!

I want to contact several of my creditors to settle some debts. However, I don’t want to give them my current work and living info. I only want them to send me pay off amounts, etc. Also, can I demand that we only correspond via mail or e-mail?
