As far as a reputable lender is concerned, you make whatever you can verify. A non-reputable lender will generally get you into trouble, financially and legally.

Did we really spike the economy with Cash for Clunkers, or just put more people into further personal debt?

January 26th, 2012

Question by Uncle Tom: Did we really spike the economy with Cash for Clunkers, or just put more people into further personal debt?
Americans could learn a lot from working with Jewish people. If a Jew needs a computer, and one has a 1 year warrant and is $ 300.00 and the other has a 5-year warrant and is $ 325.00, they’ll almost always buy the $ 300.00 system. Then they put the extra $ 25 in their bank account. That’s why most are rich! They would never trade in a paid for running car for a new one with a car payment.

Pat: I’d say $ 3Billion dollars is a lot of money to hire just 1200 workers.
1500, what ever. That’s $ 2,000,000/worker. I could do that without putting a bunch of people in debt.

A false spike and yes probably more personal debt they may or may not be able to pay. It’s turned into a great big fiasco.

can a debt collector seize $ / assests from my LLC for a personal credit card debt not connected to the LLC ?

January 24th, 2012

Question by Rubberband Man: can a debt collector seize $ / assests from my LLC for a personal credit card debt not connected to the LLC ?
i have some credit card debt probably 3-4 cards to the tune of about $ 5,000. that was prior to my forming my self employed service business into an LLC (ohio), and this debt has no connection to the LLC (single member) and if i am not able to settle or othewise make payments its likely they will go to court and get a judgement. SO…. what then? can they with such a judgement seize personal property? such as a motorcycle ( $ 4,000.) or attach a lein on my house? Can i open an LLC for just me as a person? to be alble to continue living ( paying bills) or will i have to use “undercover” services to pay my bills? My LLC will be paying me…. do i ihave to live and pay with cash forever? I want to pay or settle wilth them but if i can not i have decided to keep my house (by paying on IT) VS lose my credit / credit cards by NOT paying on them

Q&A: What is the NJ statute of limitations on collecting a personal debt?

January 23rd, 2012

Question by Anne G: What is the NJ statute of limitations on collecting a personal debt?
10 years ago I was in some legal trouble, and my aunt paid for a lawyer to represent me in court. She then wrote me a letter telling me that I had to pay her back about $ 2000 for the lawyer’s fee. I never signed a contract with her, nor did I make an oral agreement. She simply outlined the payment plan in her letter. I made monthly payments for about a year then stopped because I was broke. She never contacted me to get the rest of the money, then I lost contact with her after I moved to Florida. I have lived in FL since 2001. She now has my new address and I was wondering what to do if she writes and demands the money. Is there a statute of limitations? If she took me to court for the money, would she have a case? Does a payment plan in a letter count as a legally binding agreement? If there was a case, who would have jurisdiction, NJ or FL?

Answers from legal professionals are preferred. Please back up your answer with specific citations from NJ law. Serious answers only. Childish answers will be ignored. Thanks

New Jersey Statutes of Limitation

Conversion of an instrument for money: 3 years, (N.J.S.A.12A: 3-118(g)).

Sale of goods under the UCC: 4-years, (N.J.S.A. 12A; 2-725).

Real or personal property damage, recovery and contracts not under seal: 6 years (N.J.S.A. 2A: 14-1).

Demand Notes when no demand is made: 10 years. If demand made: 6 years from date of demand, (12A: 3-118(b)).

Obligations under seal for the payment of money only, except bank, merchant, finance company or other financial institution: 16 years, (N.J.S.A. 2A: 14-4) actions for unpaid rent if lease agreement is under seal, (N.J.S.A. 2A: 14-4).

Real estate: 20 years, (N.J.S.A. 2A: 14-7); Judgments: 20 years, renewable, (2A: 14-5); Foreign judgments: 20 years (unless period in originating jurisdiction is less), (2A: 14- 5).

Unaccepted drafts: 3 years from date of dishonor or 10 years from date of draft, whichever expires first, (12A: 3- 118(c)).

The SoL stops when you are outside of the jurisdiction of the court, such as when you lived in FL. Also, your payments is evidence that shows you acknowledge the debt.

Even if the SoL has elapsed you still owe the money, she just can’t sue you for it.

You have a debt on your credit report. Can your wages be garnished if you make payments via check?

January 23rd, 2012

Question by enance: You have a debt on your credit report. Can your wages be garnished if you make payments via check?
I have a medical bill on my credit report that I would like to make payments on. If I begin to make payments on this debt via personal
check, can they automatically garnish the funds from my checking account?

Best answer:

Answer by DCResident
They would have to get a court order for the full amount unless you wrote them and stated that had permission to freely garnish that money.

Have you gotten any hinto of court proceedings for the money?

So if they do so without a court order it would be illegal.

Q&A: Will it cost me more to repay a personal debt?

January 22nd, 2012

Question by : Will it cost me more to repay a personal debt?
My best guy friend since high school helped me out with some bills when I was having a really difficult time. He said “gave” me money and I said “lent” me money. He never asked or anticipated being paid back (to my knowledge). I always said I was going to pay him back.

We are both married. My husband left me and his wife cheated on him. He and I expressed feelings for one another. He decided to reconcile with his wife, something I wholeheartedly support. She has contacted me a couple times to ridicule me for my behavior (which was reprehensible, I know), but I have had no contact with him during that time. It’s been almost a year.

The last email I sent him promised I would pay him back. I am now in a financial position to do so and I would like to. I’m not looking for any contact from him. I would overnight the cash to his office so his wife wouldn’t have to know about it unless he wanted to tell her.

I think it’s important to pay back my friend, but not to cause further issues in his relationship. Am I able to do both??
I have let it go. I just don’t like feeling like I have an outstanding responsibility.

Also, the amount of the debt is $ 1,200. Not exactly pocket change.

Best answer:

Answer by olderwiser100a
of course you can. your plan to overnight a cashier’s check to his office should suffice. and btw, your behavior was not reprehensible. you both were in effect single, so acting as you did was certainly well above board. and finally, kudos to you. most would have not repaid the debt.
